Phase I ESA, Phase II ESA, Coordination of Spill Closure with the NYSDEC

The owner of the property was performing their environmental due diligence requirements for the property.  During the Phase I ESA it was discovered that a New York State Department of Environmental Conservation (NYSDEC) spill number was associated with the property for contaminants identified in the groundwater by a prior consultant.    The Phase I ESA therefore, recommended a Phase II ESA which Hydro Tech coordinated with the NYSDEC and then performed in accordance with their recommendations.  The Phase II ESA identified contamination in the groundwater but no contamination in the soil.  Hydro Tech approached the NYSDEC with the results of the investigation and requested the spill to be closed since the source appeared to be off-site.  The NYSDEC agreed and the Spill Number was transferred to the adjacent gasoline station.  The owner was therefore able to close his loan without any further work or responsibility.
